Be Prepared

  • Bring a Good Flashlight or even spotlight: (you could spot something other bidders don’t notice)
  • Bring Padlocks: (you will need to lock your storage units until the auction is over)
  • Bring Cash: ( Most Storage auctioneers require cash on hand only. They won’t let you “run to the ATM real quick” )
  • Set a Budget: ( Don’t get caught up in bidding fever or bidding wars.  Good rule to follow is “only bid on what you can see” the rest is a gamble. You don’t want to end up  paying the storage facility a fee Just  for the privilege of cleaning out 1 of their units:)

Leave the storage unit clean: ( Remember you have to leave the storage unit clean.)

Several items you might consider bringing with you:  Broom, Rubber gloves, Trash bags, Hand Truck, Some basic Tools , Maybe even bolt cutters

Don’t Overwhelm Yourself

Typically , you are only going to have 24 hours to clean out the unit that you won in your auction.  If you win a 5×5 or a 5×10, then this may not be to hard a task.  But If you end up winning something like a 10×20 or 10×30 size unit, then chances are that you are going to have a lot of stuff to get out of that unit within 24 hrs.  Most Storage Locations require you to clean out within 24hrs. Some will work with you but don’t count on it.

Look in every box:

Look at items very closely: (you might find a valuable old coin in that cheap plastic piggy bank)

Develop good sorting practices so you don’t over look valuable items. Quickly sort the items you know are valuable away from the trash

Have a good exit strategy

Ask your self a few questions:

  • Do i need help cleaning out the unit?
  • What size truck will i need?
  • Where will i store all the items i won?
  • Where will i sell the items ive won?
  • Where can i find antique dealers or appraisers?
  • What do things sell for on craigslist?

Although you do find those rare valuable items such as guns, antiques, jewelry, and other collectibles.  Your bread and butter items are going to be items everyone has in their house. TV’s Furniture , beds, washers and dryers etc.. Getting familiar with current second hand prices and how to determine these values quickly will help you become a very successful storage auction buyer.

TITLE 5. EXEMPT PROPERTY AND LIENS
SUBTITLE B. LIENS
CHAPTER 59. SELF-SERVICE STORAGE FACILITY LIENS
SUBCHAPTER A. GENERAL PROVISIONS

Sec. 59.001.  DEFINITIONS.  In this chapter:
(1)  “Lessor” means an owner, lessor, sublessor, or managing agent of a self-service storage facility.
(2)  “Rental agreement” means a written or oral agreement that establishes or modifies the terms of use of a self-service storage facility.
(3)  “Self-service storage facility” means real property that is rented to be used exclusively for storage of property and is cared for and controlled by the tenant.
(4)  “Tenant” means a person entitled under a rental agreement to the exclusive use of storage space at a self-service storage facility.

Sec. 59.002.  APPLICABILITY.  This chapter applies to a self-service storage facility rental agreement that is entered into, extended, or renewed after September 1, 1981.

Sec. 59.003.  APPLICABILITY OF OTHER STATUTES.  (a)  Subchapter B, Chapter 54, does not apply to a self-service storage facility.
(b)  Unless a lessor issues a warehouse receipt, bill of lading, or other document of title relating to property stored at the facility, the following statutes do not apply to a self-service storage facility:
(1)  Chapter 7, Business & Commerce Code, as amended; and
(2)  Chapter 14, Agriculture Code.

Sec. 59.004.  VARIATION BY AGREEMENT AND WAIVER.  Except as expressly provided by this chapter, a lessor or tenant may not vary the provisions of this chapter by agreement or waive rights conferred by this chapter.

Sec. 59.005.  DAMAGES FOR VIOLATION.  A person injured by a violation of this chapter may sue for damages under the Deceptive Trade Practices–Consumer Protection Act (Subchapter E, Chapter 17, Business & Commerce Code).

Sec. 59.006.  ATTACHMENT AND PRIORITY OF LIEN.  A lien under this chapter attaches on the date the tenant places the property at the self-service storage facility. The lien takes priority over all other liens on the same property.

Sec. 59.007.  PURCHASE OF PROPERTY.  A good faith purchaser of property sold to satisfy a lien under this chapter takes the property free of a claim by a person against whom the lien was valid, regardless of whether the lessor has complied with this chapter.

Sec. 59.008.  REDEMPTION.  A tenant may redeem property seized under a judicial order or a contractual landlord’s lien prior to its sale or other disposition by paying the lessor the amount of the lien and the lessor’s reasonable expenses incurred under this chapter.

Sec. 59.021.  LIEN; PROPERTY ATTACHED.  A lessor has a lien on all property in a self-service storage facility for the payment of charges that are due and unpaid by the tenant.

SUBCHAPTER C. ENFORCEMENT OF LIEN

Sec. 59.041.  ENFORCEMENT OF LIEN.  (a)  Except as provided by Subsection (b) of this section, a lessor may enforce a lien under this chapter only under a judgment by a court of competent jurisdiction that forecloses the lien and orders the sale of the property to which it is attached.
(b)  A lessor may enforce a lien under this chapter by seizing and selling the property to which the lien is attached if:
(1)  the seizure and sale are made under the terms of a contractual landlord’s lien as underlined or printed in conspicuous bold print in a written rental agreement between the lessor and tenant; and
(2)  the seizure and sale are made in accordance with this chapter.

Sec. 59.042.  PROCEDURE FOR SEIZURE AND SALE.  (a)  A lessor who wishes to enforce a contractual landlord’s lien by seizing and selling or otherwise disposing of the property to which it is attached must deliver written notice of the claim to the tenant.
(b)  If the tenant fails to satisfy the claim before the 15th day after the day that the notice is delivered, the lessor must publish or post notices advertising the sale as provided by this subchapter.
(c)  If notice is by publication, the lessor may not sell the property until the 15th day after the day that the first notice is published. If notice is by posting, the lessor may sell the property after the 10th day after the day that the notices are posted.

Sec. 59.043.  CONTENTS AND DELIVERY OF NOTICE OF CLAIM.  (a)  The lessor’s notice to the tenant of the claim must contain:
(1)  an itemized account of the claim;
(2)  the name, address, and telephone number of the lessor or the lessor’s agent;
(3)  a statement that the contents of the self-service storage facility have been seized under the contractual landlord’s lien; and
(4)  a statement that if the claim is not satisfied before the 15th day after the day that the notice is delivered, the property may be sold at public auction.
(b)  The lessor must deliver the notice in person or by certified mail to the tenant’s last known address as stated in the rental agreement or in a written notice from the tenant to the lessor furnished after the execution of the rental agreement. Notice by mail is considered delivered when the notice, properly addressed with postage prepaid, is deposited with the United States Postal Service.

Sec. 59.044.  NOTICE OF SALE.  (a)  The notice advertising the sale must contain:
(1)  a general description of the property;
(2)  a statement that the property is being sold to satisfy a landlord’s lien;
(3)  the tenant’s name;
(4)  the address of the self-service storage facility; and
(5)  the time, place, and terms of the sale.
(b)  The lessor must publish the notice once in each of two consecutive weeks in a newspaper of general circulation in the county in which the self-service storage facility is located. If there is not a newspaper of general circulation in the county, the lessor may instead post a copy of the notice at the self-service storage facility and at least five other conspicuous locations near the facility.

Sec. 59.045.  CONDUCT OF SALE.  A sale under this subchapter must be a public sale at the self-service storage facility or a reasonably near public place. The lessor must conduct the sale according to the terms specified in the notice advertising the sale and sell the property to the highest bidder.

Sec. 59.046.  EXCESS PROCEEDS OF SALE.  If the proceeds of a sale under this subchapter are greater than the amount of the lien and the reasonable expenses of the sale, the lessor shall deliver written notice of the excess to the tenant’s last known address as stated in the rental agreement or in a written notice from the tenant to the lessor furnished after the execution of the rental agreement. The lessor shall retain the excess and deliver it to the tenant if the tenant requests it before two years after the date of the sale. If the tenant does not request the excess before two years after the date of the sale, the lessor owns the excess.

Sec. 59.047.  ADDITIONAL PROCEDURES FOR SALE OF CERTAIN PROPERTY.  A holder of a lien under this chapter on a motor vehicle subject to Chapter 501, Transportation Code, or on a motorboat, vessel, or outboard motor for which a certificate of title is required under Subchapter B, Chapter 31, Parks and Wildlife Code, may follow the procedures prescribed by Section 70.006 in addition to the procedures prescribed by this chapter.

Cowboys Safety Roy Williams Will Star In Storage Wars Dallas

Roy Williams the former Oklahoma star and Cowboys safety that spent the last two years in Parts Unknown Cincinnati. Williams is a free agent, but hasn’t been picked up by a team this offseason. However, he’s making the most of it. Reportedly, Roy Williams will star in a Dallas based spinoff of the hit A&E show Storage Wars. YEEEEEEP!!! From ESPN Dallas…

Safety Roy Williams, the Cowboys’ first pick in the 2002 draft, still wants to play in the NFL.
But if you don’t catch him playing on Sundays, then you can watch him this fall on the reality show “Storage Wars: Dallas,” a spinoff of the successful A&E show that just finished its first season.

 

“My agent is trying to find me a team,” Williams said in a text message. “I’m not retired, but I am filming Storage Wars here in Dallas, which I’m having a blast doing.”

The show features professional buyers and their teams going through repossessed storage units in hopes of finding valuable goods.

Williams spent the last two seasons playing for Cincinnati. He played 12 games last season, finishing with 59 tackles, a sack, an interception and three fumble recoveries.

As a sometimey connoisseur of reality based programming, Storage Wars has quickly turned into one of my favorite television shows. Much like Pawn Stars, the format is simple and consistent, but the characters are truly what makes the show compelling. There’s the added element of dreaming to yourself that you could go around old storage units and make money or actually own some old piece of crap that’s really worth thousands of dollars. If Roy Williams (who I assume has deep pockets and hasn’t Antoine Walkered his money away) can turn into the Dallas version of either Dave or Barry, this Dallas spinoff will be off to a great start. I’ll be very disappointed though if there isn’t at least one buyer wearing a cowboy hat. While we’re at it, I’d love to see an hour long special where Mark Cuban and Jerry Jones go around Dallas and bid on random things. Could Cubes buy JerryWorld? That could be fun too.

A&E’s most-watched series STORAGE WARS is moving to a new night when it returns with back-to-back all-new episodes on Tuesday, November 15 at 10PM ET/PT. Sixteen half-hour episodes of the new original series “Storage Wars: Texas” will follow beginning Tuesday, December 6 at 10:30PM ET/PT.

STORAGE WARS ranks as A&E’s highest-rated series of all time, averaging 4.7 million total viewers, 2.7 million A25-54 and 2.6 million A18-49 during its current season. On September 7, 2011, the series had its most-watched episode ever, hitting 5.3 million total viewers, and becoming A&E’s most-watched series telecast of all time.

In these all new episodes of “Storage Wars,” the quest for gold heats up in California as our fearless buyers drop some serious cash. Jarrod and Brandi finally expand, but the grand re-opening of their store could drown them in a sea of red. Darrell Sheets works his way out of a yearlong hole, and finally gambles on some overhead. Dave Hester defends his Mogul status by literally building a fleet. And Barry Weiss goes for a drive with his mom, but will they ever come back? In “Storage Wars: Texas,” A&E’s top-rated non-fiction franchise heads to the Lone Star state to follow teams of bidders on their quest for auction gold. New Texas-based characters include, self-employed Lesa Lewis who is searching for items to sell at her brand-new thrift store. Her pockets may not be deep, but she is a doggedly determined bidder when she sees a unit she wants. No job is too big for her right-hand man Jerry Simpson, who is always there to lend a hand and share a few laughs. Seasoned bidder Ricky Smith has been in the business since the age of 14, and says he is here to stay. He has spent the past 20 years teaching his nephew Bubba, who attends the auctions with him, the tricks of the trade. New York native Victor Rjesnjansky relocated to Texas, where he bids on storage auctions to fill the shelves of his store. The “fabulous” Moe Prigoff has been collecting modern furniture and antiques for over 30 years and is always on the lookout for new items to sell in his exclusive antique gallery. Rallying the crowd of high bidders is fast-talking auctioneer Walt Cade, who will do whatever it takes to move the units – and land one storage hunter a shot at hidden treasure.
